General conditions

These are the General Conditions of The Jewelry Story, a business partnership established under Dutch law. The Jewelry Story is situated at Tsjerkereed 4, 9241 HH Wijnjewoude, the Netherlands. E-mail: info@thejewelrystory.com Telephone: +31 (0)516 481857. Registered with the Chamber of Commerce in Leeuwarden under no. 01060903, VAT (turnover tax) number: NL008296522B01. These General Conditions apply to all agreements related to purchasing and selling entered into by The Jewelry Story and its customers via The Jewelry Story website (hereinafter referred to as “the Website”). By clicking on “Accept” you state that you agree with the contents and their applicability to your agreement with The Jewelry Story. An account cannot be created without your agreeing to these conditions.

PURCHASING
You can place an order via The Jewelry Story online shop by clicking on any article(s) that you wish to acquire. This causes the article(s) to be placed in your “Shopping Bag”. Subsequently you can check your Shopping Bag and change its contents if you so wish. Once the contents of the Shopping Bag are to your liking, you click on the “Next” button causing an order form to be created listing the articles you wish to buy. When you have filled in the order form, including the payment information, you click on “Purchase” and your order is completed. When your order is being processed, The Jewelry Story sends you an e-mail confirming that your order has been received. The purchase and sale agreement comes into force the moment that e-mail is sent. The agreement in question is thus regarded as having been made in the Netherlands. However The Jewelry Story reserves the right at all times and/or for whatever reason to refuse to supply its services and/or goods to any individual as it sees fit.

PRICES AND INFORMATION ON THE WEBSITE
The prices as stated on the website are inclusive of VAT (Dutch turnover tax) but exclusive of shipping costs. On request we can send you an invoice with specified VAT information. The total price stated on the list of orders and on the electronic order form is inclusive of shipping costs. All customs charges or import taxes and/or local taxes are the responsibility of the customer and are not included in the price. Prices can change at any time. Price changes do not affect the amount due for goods already ordered in a purchase and sale agreement confirmed by The Jewelry Story in an e-mail. Although we do everything we can to make sure that all information relative to prices, specifications etc. on the Website is accurate and up to date, we cannot guarantee its absolute accuracy. The Jewelry Story is not obliged to deliver orders placed on the basis of incorrect information on the Website. Some links on the Website give access to sites and sources of information exploited and maintained by third parties. The Jewelry Story has no control over such sites and cannot be held responsible for their contents.

PAYMENT
Payment can be made using credit cards or alternative payment methods. When you use a particular credit card (number) you confirm that the credit card is yours. The amount charged is taken from your account once your order has been accepted by The Jewelry Story. All credit card holders are subject to validation checks and to permission from the credit card company. If the latter refuses to approve your payment to The Jewelry Story, we will postpone the delivery and contact you. In such a case The Jewelry Story cannot be held responsible for any delay or failure to deliver. Credit card information is processed by means of an SSL (secured socket layer) connection. The Jewelry Story cannot be held responsible for misuse of this information by third parties.

SUPPLY AND DELIVERY
The Jewelry Story does its utmost to ensure that all purchases are delivered within the time-scale stated on the Website. But sometimes we depend for this on our suppliers. In consequence, all delivery times stated on the Website are merely an indication. The Jewelry Story can in no way be held responsible for a delivery being made at a later date. Failure to deliver at the time stated and/or failure to deliver within thirty days of the order being placed does not automatically mean that The Jewelry Story is in default.
Deliveries are made by a Nedpak courier, or postal service. If the courier, or postal service is unable to hand over your order to you personally on the first attempt, he will leave information about the branch where your goods are being kept. Unless otherwise instructed, the courier, or postal service will return on the following (working) day and will again leave a message if the order cannot be delivered personally. All articles are insured by The Jewelry Story up to the time they are delivered to your address. Any complaints with regard to the state in which the goods are delivered must be reported to The Jewelry Story, by e-mail or telephone, no later than two days after taking delivery of the goods.

RETURNING GOODS
Any goods purchased from The Jewelry Story can be returned after cancellation of the order within seven days after delivery. Returned goods must be sent by registered post with insurance and the shipping costs must be met by the customer. Cancellation is possible only by sending an e-mail to info@thejewelrystory.com stating the reason why the goods are being returned. Cancellation immediately terminates the sale and purchase agreement between The Jewelry Story and the customer and obliges the customer to return the goods to The Jewelry Story within 7 days after cancellation. Cancelled orders must be returned within seven days after cancellation via registered post with insurance. Shipping costs are the responsibility of the customer. Payments made for products returned in the correct manner will be transferred back to the credit card account of the original purchaser. In order to qualify for repayment, the returned jewelry must be in a new, unused and unworn state. New and unused means without damage, scratches or other signs of the jewelry having been worn or used. It is not possible to exchange jewelry specially made to the customer’s order. The same applies to jewelry that has been modified or made to measure at the customer’s request.

PRIVACY
The Jewelry Story respects your privacy. The information you supply via the Website will be used exclusively to process your order and to inform you about The Jewelry Story and its products.

LIABILITY
The Jewelry Story’s liability towards the purchaser is limited to the amount paid for the jewelry ordered. The Jewelry Story can never be held liable for loss of profits or loss of goodwill or any other subsequent damage.
